Commercial Co-Venture Status
We have been notifed that certain charities conisider programs such as ours commercial co-ventures. We are in the process of communicating with the offices of the Attorney's General for all 50 states to determine what requirements,
if any, govern such activities in each state. It is our goal to comply to the fullest extent possible to be able to conduct business in as many states as possible. If commercial co-venturing regulations affect your relationship
with UMDonations.com, check this tab periodically to monitor our progress, as we will post updates regularly.
UPDATE May 8, 2007: We will be registering shortly with all states requiring registration. Five states, Arkansas, Connecticut, New Hampshire, New Jersey, Utah, and Washington have contract filing requirements as well.
The following states - Alabama, Illinois, Maine, and Massachusetts - require cash bonds totaling over $50,000. While people who live in these states may book travel through Ultimate Choice Travel, travel purchases from
residents of these four states will be exempt from generating contributions until a later date.
Accounting & Tax Issues
Your Responsibility
We are accepting your identity at face value and the legitimacy of the intended purpose of your donations. It is up to you to submit to us the appropriate name and address for the person receiving these donations, that they are used for the intended purpose, and that any tax consequences for the charitable gifts to your organization are properly recorded and accounted for by your organization in compliance with all local, state, and federal laws. We will send the appropriate tax paperwork at the end of the calendar year to all organizations receiving donations. It is up to you and your organization to determine whether your receipt of our contributions is non-taxable, tax deductible, or taxable and at what rate(s).
Our Responsibility
All revenue received by each agent's site is the responsibility of that agent individually. Each agent is also individually responsible for the taxes on all recorded revenue. The responsibility of UMDonations.com is to oversee the travel purchases through this site and to verify that all charitable donations offered are provided in an accurate and timely fashion.
Donation Oversight
All income from these sites and donations provided to the appropriate organizations will be analyzed monthly by a major accounting firm headquartered in Lexington, Kentucky, to determine the accuracy of all commissions
and donations. Formal reports can be provided to larger organizations that require them. To communicate directly with a representative of the firm regarding this program, please send your inquiry to umdonations@ddfky.com.
Timeliness of Donations
Commissions are paid to agents only after travel is paid for and completed. Prior to travel being completed, it is subject to credit, refund, etc. If paid travel is missed, unless it was purchased as non-refundable,
it may still be subject to credit towards future travel and will therefore not generate a commission to a travel agent. Commissions on a trip purchased six months in advance, for instance, will not be paid until the month
following the completion of the trip. All donations are paid within 30 days of the receipt of the commission. For these reasons, donations are not calculated based upon the date travel is purchased.
We specifically reserve the right to decline to list or donate to any specific charity.
